Terms of Service

Welcome to WhatsLink. These Terms of Service ("Terms") govern your access to and use of the WhatsLink platform, website, and services (collectively, the "Service"). By using WhatsLink, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you agree to these Terms for that organization and represent that you have the authority to bind that organization to these Terms.

1. Description of Service

WhatsLink provides a WhatsApp Business Platform integration that allows businesses to manage messaging, automate workflows, and send broadcasts via the Meta WhatsApp Cloud API. The Service includes a shared inbox, analytics, chatbot flow builder, and developer APIs.

2. Account Registration and Security

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized use of your account. WhatsLink reserves the right to suspend or terminate accounts that provide false information or violate security protocols.

3. Acceptable Use and Compliance

Meta Policies: You must strictly adhere to Meta's WhatsApp Business Platform Terms of Service and WhatsApp Business Policy. Any violation of Meta's policies is a violation of these Terms. Anti-Spam: You agree not to use WhatsLink for sending unsolicited messages (spam). You must ensure that you have obtained proper consent from recipients before sending messages. Lawful Use: You agree to use the Service only for lawful purposes and in compliance with all applicable laws in your jurisdiction, including but not limited to the laws of the United Republic of Tanzania and other East African Community member states. Prohibited Content: You may not use the Service to transmit content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.

4. Billing, Payments, and Credits

Currency: All internal calculations and balances are maintained in Tanzanian Shillings (TZS). Prepaid Model: WhatsLink operates on a prepaid "LUKU" model. You must maintain a sufficient balance in your Credit Ledger to send messages. Billing Categories: Messages are charged based on categories (Marketing, Utility, Authentication, Service) at rates defined in the Service. Subscriptions: Subscription plans are billed monthly or annually. Included message balances, if any, are credited to your account upon successful payment. No Refunds: Payments for subscriptions and credit top-ups are generally non-refundable, except as required by law. Hard Stop: The Service will automatically block message sending if your available balance is insufficient to cover the cost of the message.

5. Intellectual Property

WhatsLink Property: WhatsLink and its licensors own all rights, title, and interest in and to the Service, including all software, design, and trademarks. User Content: You retain ownership of the data and content you upload to the Service. You grant WhatsLink a limited license to process this data solely for the purpose of providing the Service.

6. Data Privacy and Security

Our Privacy Policy explains how we collect and use your information. By using the Service, you agree to the collection and use of your data as described in the Privacy Policy. Tenant Isolation: WhatsLink employs strict tenant isolation to ensure your data is not accessible by other users. Audit Logs: For security and compliance, WhatsLink maintains immutable audit logs of all significant actions performed within your account.

7. Limitation of Liability

WhatsLink is not liable for any service interruptions caused by third-party providers, including but not limited to Meta, Selcom, or internet service providers. To the maximum extent permitted by law, WhatsLink shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Service.

8. Termination

You may cancel your account at any time. WhatsLink reserves the right to suspend or terminate your access to the Service for any violation of these Terms or if your use of the Service poses a risk to the platform or other users.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Republic of Tanzania.

10. Changes to Terms

WhatsLink may update these Terms from time to time. We will notify you of any significant changes by posting the new Terms on our website or through the Service. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
